Skadden — on behalf of Caesars Entertainment, Inc. and related affiliates — prevailed on a motion to dismiss a consolidated amended antitrust class action complaint alleging a conspiracy among casino-hotels to adopt algorithmic pricing suggestions provided by the Rainmaker Group for their hotel rooms in Atlantic City. Judge Karen Williams of the U.S. District Court for the District of New Jersey dismissed the consolidated amended complaint with prejudice, holding that “the Court cannot infer a plausible price-fixing agreement between the Casino-Hotels from the mere fact that they all use the same pricing software.” Boris Bershteyn, Michael Menitove, Tansy Woan and Kenneth Schwartz led the Skadden team.
