On September 10, 2024, the Uzbekistan President signed the Law “On amendments legislative acts in connection with the further improvement of the legal protection system for Intellectual Property objects”.
A new procedure will allow patentees and trademark holders to seek compensation from infringers, rather than requiring reimbursement for damages related to the unlawful use of IP-right objects. Compensation will be owed regardless of whether actual damages were incurred. Compensation amounts will range from 20 to 1,000 basic calculation units (at the time of writing this article, one BCU is 375,000 Uzbekistan Soms, approx. $29.26 USD), considering the nature of the infringement, the infringer’s culpability, and industry practices. This amount can be negotiated by the parties involved or determined by the court. The amendments will come into force on December 12, 2024.
