Taiwan – IP Court Held That Chang Chun Petrochemical Co., Ltd.’s EVOH Product Did Not Infringe The Patent Of The Nippon Synthetic Chemical Industry Co., Ltd..

In the civil patent infringement action brought by The Nippon Synthetic Chemical Industry Co., Ltd against Chang Chun Petrochemical Co. Ltd., the plaintiff alleged that the defendant’s EVOH product infringed plaintiff’s R.O.C. patient No. I356069. 

 

On August 10, 2017, the IP Court of second instance affirmed the lower court’s judgment and dismissed the appeal by The Nippon Synthetic Chemical Industry Co., Ltd. on the ground that the patent at issue was invalid by reason of lack of inventive steps. 

 

Tsar and Tsai represented Chang Chun Petrochemical Co., Ltd in this action.
