Pfizer Taiwan filed patent infringement litigations as the exclusive licensee of Taiwan Patent No. 083372 (“Patent”) against many drug companies in Taiwan in connection with the famous impotence treatment drug “Viagra”.
The IP court previously rendered the judgment No. 103-Min-Zhuan-Su-55 which dismissed Pfizer’s civil action, holding that Pfizer Taiwan is not a lawful licensee of the Patent because Pfizer Ireland Pharmaceuticals (“Pfizer Ireland”), who’s not a party of the action, did not acquire the patent right of the Patent due to discontinuous assignments. Pfizer has appealed that decision.
The IP Court nonetheless rendered the judgment No. 105-Min-Zhuan-Shang-8 in April 2018 dismissing Pfizer’s appeal from the administration decision, holding that the assignments of the Patent were discontinuous and no patent right was infringed because Pfizer Taiwan failed to prove that it was the lawful licensee of the Patent.
