Indonesia – Visa And Stay Permits In The New Normal.

On 1 October 2020, the Minister of Law and Human Rights (MOLHR) issued Regulation No. 26 of 2020 on Visa and Stay Permits During the New Normal Adaptation (Regulation 26). This new regulation revoked MOLHR Regulation No. 11 of 2020 on Temporary Prohibition on Foreigners Entering Indonesia.
 

Regulation 26 allows the following foreigners to enter Indonesia through designated Immigration Border Controls after undergoing the health protocol procedure determined by the ministry in charge of mitigating the COVID-19 outbreak:
 

1. holders of Service Visas (Visa Dinas)

2. holders of Diplomatic Visas (Visa Diplomatik)

3. holders of Visit Visas (Visa Kunjungan)

4. holders of Limited Stay Visas (Visa Tinggal Terbatas or VITAS)

5. holders of Service Stay Permits (Izin Tinggal Dinas)

6. holders of Diplomatic Stay Permits (Izin Tinggal Diplomatik)

7. holders of Temporary Stay Permits (ITAS)

8. holders of Permanent Stay Permits (ITAP)

9. transportation crew members

10. holders of Asia-Pacific Economic Cooperation (APEC)

11. Business Travelcard holders of Traditional border crossing (Pelintas Batas Tradisional) pass/card

 

Visa-Free Facility and Visa on Arrival
 

Regulation 26 temporarily suspends to grant the Visit Visa Free Facility (Bebas Visa Kunjungan) and Visa on Arrival (Visa Kunjungan Saat Kedatangan or VOA) until the COVID-19 pandemic is declared over by the ministry in charge of mitigating the COVID-19 outbreak.
 

Visit Visa
 

For Visit Visas, Regulation 26 only allows applications for a single entry visit visa for the following activities:
 

1. performing emergency and urgent work

2. attending business meetings

3. conducting a purchase of goods

4. performance of probationary work by a foreign worker

5. being aid and support staff for medical, food, and humanitarian reasons

6. being a transportation crew member who joins a vessel in Indonesia

 

Limited-Stay Visa (Visa Tinggal Terbatas or VITAS)
 

Regulation 26 allows applications for VITAS for the following working and non-working activities.
 

Working activities:
 

1. being a professional or expert

2. working on a vessel, rig, or installation operating in Indonesian waters

3. performing a quality check on goods or production

4. inspecting or auditing a branch office in Indonesia

5. providing after-sales service

6. installing and repairing machines

7. performing construction-related temporary work

8. being a foreign job candidate performing probationary work
    

Non-working activities:
 

1. conducting foreign investment

2. family reunification

3. traveling as an elderly foreign tourist

 

Visit Visa and VITAS Application Requirements
 

To obtain approval for a Visit Visa and VITAS, the sponsor of the foreigner needs to submit an online application and provide the following documents:
 

1. health certificate containing a statement in English issued by the relevant authority in the foreigner’s country of origin that the foreigner is COVID-19 free

2. statement letter in English stating the foreigner’s willingness to quarantine and/or obtain medical treatment at their own expense if upon arrival in Indonesia they have a positive PCR test or show symptoms of COVID-19

3. statement letter affirming the foreigner’s willingness to be medically monitored during any quarantine period

4. evidence of health/travel insurance participation that encompasses medical coverage, and/or a statement letter regarding the foreigner’s willingness and ability to pay for their own treatment if they become infected with COVID-19 during their stay in Indonesia
    

Regulation 26 also requires the sponsor to provide evidence showing possession of at least US$10,000 to cover the foreigner’s living costs in Indonesia. This requirement is waived for aid and support staff for medical, food and humanitarian reasons and transportation crew members.

 

Visit Stay Permit
 

Regulation 26 allows foreigners currently in Indonesia holding expired stay permits originating from a VOA, single-entry or multiple-entry Visit Visa and an APEC Business Travel Card to apply for a stay permit extension at the relevant local Immigration Office.

The stay permit extension can be granted for a maximum of 30 days.

Visit stay permits originating from a VOA and single entry Visit Visas can be converted to an ITAS.

 

Temporary Stay Permit (ITAS) and Permanent Stay Permit (ITAP)
 

Expired ITAS and ITAP holders who are currently in Indonesia can apply for a renewal of the ITAS and ITAP.
 

A renewed ITAS can be converted to an ITAP.
 

Foreigners who hold an ITAS or ITAP that can no longer be renewed can be granted a new stay permit after first obtaining a visa approval.
 

Holders of expired ITAS, ITAP and Re-entry Permits who are currently outside Indonesia must apply for a new visa to enter Indonesia.

 

VITAS and Visa Holders Outside Indonesia
 

Foreigners holding an expired VITAS or visa approval who have not yet entered Indonesia need to apply for a new visa before entering Indonesia.

 

Administrative Sanction
 

Foreigners who fail to apply for, renew or extend their stay permit while residing in Indonesia may be subject to immigration administrative actions as regulated under the applicable laws and regulations.
