On 10 July 2020, the Ministry of Human Resources and Social Security and the Supreme People’s Court (“SPC”) jointly published the first batch of typical labour dispute cases (the “Typical Cases”). Shortly after, on 27 July, the SPC issued guiding opinions for courts to unify the application of laws and make increased reference to similar cases. Against this backdrop, the Typical Cases will undoubtedly serve as guidance at the hearings of labour dispute cases by labour arbitration tribunals and people’s courts at various levels, thus being useful reference for companies in their day-to-day management.
