Is an agreement containing a mistake enforceable?
In the recent case Zhang Qiang vs. Cisco Systems (HK) Limited, Deacons successfully defended all the claims made against Cisco. In this seventh episode of "Labour Law Grab n Go" video series, our Employment Partner Elsie Chan discusses this case concerning the enforceability of a separation agreement containing a mistake. The Court of First Instance held that in the context of unilateral mistake, a party cannot enforce a contract on terms which he knew or should have known did not reflect the other party’s intention.
