Crowell & Moring secured a complete dismissal and possible attorneys’ fees in a false labeling case for Mondelez, LLC in the Northern District of Illinois.
Over the past several months, Mondelez, LLC has been sued numerous times by plaintiffs’ counsel Spencer Sheehan. In this case, the plaintiff alleged that she was deceptively lured into buying a pack of “Original Flavor” Trident gum after seeing an image of a blue leaf on the package, and thought the gum would have actual mint or peppermint in it, rather than gum with artificial mint flavor.
The Court ruled that the labeling was not false, deceptive, and misleading, and granted a complete dismissal, with prejudice of the case.
