SSEK Law Firm was pleased to be part of the 8th ICC Indonesia Arbitration Day, held on 23 September 2026 in Jakarta.
SSEK Partner Nico A. P. Mooduto spoke during the session “Managing Privilege Issues in Arbitration: Rule of Thumb, by the Book?”, which explored different approaches to legal professional privilege across jurisdictions.
Among the key issues discussed was the distinction between common law and Indonesian approaches to privilege. While legal professional privilege is recognized as a doctrine in common law jurisdictions, Indonesia takes a different approach, with advocates’ confidentiality obligations primarily governed by the Advocates Law. This distinction can raise important practical considerations in cross-border and international arbitration, particularly where parties and counsel are subject to different legal and professional standards.
