Do you need to hire foreign national employees in 2022? If you do, good news! The Ministry of Labour and Vocational Training (MLVT) has delayed the annual deadline to apply for the foreign national workforce quota (“Annual Quota”) for the year 2022 (which was due on November 2021) to 31 January 2022.
Besides obtaining the Annual Quota, you may also want to note that work permits are also required for the employment of foreign nationals. On receiving the Annual Quota permit you may apply for work permits via the Foreign Workforce Centralised Management System (www.fwcms.mlvt.gov.kh) between 1 January 2022 to 31 March 2022.
It is likely that the Labour Inspectorate will soon begin inspecting workplaces to ensure compliance with the requirements on the hiring of foreign nationals. Enterprises, establishments, and foreign nationals who do not comply with such requirements will either be fined between USD610 and USD900 or face imprisonment.
