Generally, to overcome the clarity objections and distinguish the invention from the prior art, disclaimers in claims are incorporated.
Usually in India, incorporation of undisclosed disclaimer in claims is always questionable and hence there is an uncertainty regarding the allowance of undisclosed disclaimers.
