Greetings from the Labour and Employment Law Practice Group at AZB & Partners! Hope you are doing well and staying safe.
This is to update you about the recent notification of the Ministry of Labour and Employment appointing May 3, 2021 as the effective date for Section 142 of the Code on Social Security, 2020 (SS Code).
As per Section 142 of the SS Code any employee, unorganized worker, or any other person shall establish their identity or identity of their family members / dependents, through Aadhaar number for registration and availing the benefits contemplated under the SS Code.
This notification of Section 142 of the SS Code will enable the Ministry of Labour and Employment to collect Aadhaar details for the database of beneficiaries under various social security schemes. In this regard, the Government has announced that the ‘National Data Base for Unorganised Workers’ is at an advanced stage of development by National Informatics Centre. The portal is aimed at collection of data for unorganised workers including migrant workers for the purpose of giving benefits under various schemes of the Government. It is also clarified that Section 142 of the SS Code is notified only for collection of data for workers including migrant workers, and that benefit will not be denied to workers for want of Aadhaar.
Please note that other provisions of the SS Code are yet to be brought into effect.
Should you have any questions on legal rights, duties, and obligations of employer organisations in the context of SS Code, please do reach out to us.
