Presidential Regulation No. 148 of 2015, dated December 28, 2015, regarding the Fourth Amendment of Presidential Regulation No. 71 of 2012 regarding the Implementation of Land Procurement for Development for the Public Interest. This Regulation amends several provisions in its predecessor regulations. Among the changes, (i) the formation of the Preparation Team by governors shall now be carried out in the maximum of two business days upon the receipt of the planning document by the governors; (ii) the announcement of a development plan to the local community where the development will be carried out shall be done a maximum of three business days after the formation of the Preparation Team; (iii) in the event there is an objection to the development, such objection shall be handled by governors a maximum of three business days as of the receipt of such objection; (iv) the location for the development shall be determined by the governor a maximum of seven business days as of the agreement in determining such location; (v) land procurement by private business entities shall be conducted directly by way of sale and purchase, exchange or other means as agreed by the entitled parties and the private business entities; (vi) all references to “BPN” (the National Land Agency) shall now mean the “Ministry”; and (vii) all references to the “Head of BPN” shall now mean the “Minister”. This Regulation came into force on the date of its promulgation.
Governor of DKI Jakarta Regulation No. 13 of 2016, dated January 28, 2016, regarding the Second Amendment of Governor of DKI Jakarta Regulation No. 112 of 2011 regarding Procedures for the Imposition of Duty on the Acquisition of Rights to Land and Buildings (“BPHTB”). This Regulation amends the non-taxable tax object purchase price value to Rp 80 million for every taxpayer and Rp 350 million for inheritance and grant will (hibah wasiat). It came into force on the date of its issuance.
