Government Regulation No. 74 of 2015, dated October 1, 2015, regarding the Treatment of VAT for the Delivery of Certain Port Services to Sea Transportation Companies Conducting Overseas Sea Transportation Activities. This Regulation waives VAT for certain port services, including docking services and cargo unloading, provided to ships engaged in overseas transportation activities, either operated by national or foreign companies, provided that certain conditions as stipulated in this Regulation are met. For example, the ships must not be carrying passengers and/or cargo from one port to another port within the territory of Indonesia, and especially for ships operated by foreign companies, the state where the company is domiciled must provide the same treatment to Indonesian ships under the principle of reciprocity. This Regulation came into effect 30 days after the date of its enactment.
Governor of DKI Jakarta (“GOJ”) Regulation No. 203 of 2015, dated July 31, 2015, regarding the Amendment of Governor Regulation No. 112 of 2011 regarding the Procedure for the Imposition of Duties on the Acquisition of Rights to Land and Buildings (Bea Perolehan Hak atas Tanah dan Bangunan or “BPHTB”). This Regulation amends the amount of the Non-Taxable Tax Object Acquisition Value (Nilai Perolehan Objek Pajak Tidak Kena Pajak or “NPOPTKP”) to IDR 80 million (for every taxpayer) or IDR 350 million (for inheritance and grant (hibah wasiat)). This Regulation came into effect on the date of its enactment.
