Minister of Transportation Regulation No. PM 166 of 2015, dated October 30, 2015, regarding the Amendment of Minister of Transportation Regulation No. PM 15 of 2015 regarding Concessions and Other Forms of Cooperation between the Government and Port Business Entities in the Field of Ports. This Regulation amends the provision in its predecessor concerning the coverage of concession cooperation in port services at ports that have been constructed, developed and/or operated prior to the effectiveness of Law No. 17 of 2008 regarding Shipping. The granting of such concession is done through assignment/appointment. In the event that such concession expires it may be extended pursuant to the applicable laws and regulations. This Regulation came into effect on the date of its promulgation.
Minister of Transportation Regulation No. PM 11 of 2016, dated January 28, 2016, regarding the Implementation and Management of Ship Agency. This Regulation implements Articles 34, 155 and 176 of Government Regulation No. 20 of 2010 regarding Water Transportation. Pursuant to this Regulation, a national ship agency company or national sea transportation company shall conduct ship agency business activities. Ship agency activity is divided into foreign ship general agency and national ship agency activities. This Regulation governs, inter alia, (i) the procedures and requirements for a national ship agency company to obtain a business license from the Directorate General of Sea Transportation, (ii) the rights and obligations of ship agency companies and (iii) sanctions for the violation of certain provisions under this Regulation. This Regulation came into effect on the date of its promulgation.
