Digitalisation has taken the world by storm. In 2018, the number of internet users in Malaysia had reached 28.7 million users, an astonishing 87.4% of the population. While digitalisation has made inroads towards legal recognition, can wills be digitalised? Can someone leave a digital will for their loved ones? Are digital wills even allowed in Malaysia?
As for digital assets, does Malaysia cater for the inheritance of digital assets? Do cryptocurrencies or funds in a PayPal account count as valid assets that one could will away to their intended beneficiaries?
This article will discuss the requirements of a will and assets, and to what extent can the current legislation be applied to digital wills and digital assets. Or would there be a need for Parliament to gazette a new legislation for digital wills and digital assets.
