On 29 July 2025, the Supreme Court, in EastWest Rural Bank v. Philippine National Police Anti-Cybercrime Group Regional Anti-Cybercrime Unit 1, G.R. No. 273720, addressed whether, and to what extent, a bank may be compelled to disclose account-related information pursuant to a Warrant to Disclose Computer Data (“WDCD”) issued under Republic Act No. 10175 or the Cybercrime Prevention Act, without violating Republic Act No. 1405 or the Bank Secrecy Law.
The case arose from a “vishing” incident where a victim was deceived into providing his email address and one-time password to a caller falsely claiming to be a bank employee, which resulted in an unauthorized transfer of funds to an account maintained with EastWest Rural Bank (“EWRB”).
