Apple Inc was unsuccessful in opposing registration of the mark “
” by Penta Security Systems Inc. The opposition failed on all grounds including visual, aural, and conceptual similarity. The decision also found that there is no reasonable likelihood of confusion, and “the nature of the goods in issue, such as computers and computer software, tends to involve a considered process of selection and purchase on the part of consumers such that confusion is less likely to occur.”
