Taiwan – The Intellectual Property Court Held That The Patent Of Rohm And Haas Electronic Materials CMP Holdings, Inc. (“R&H”) Was Invalid On The Ground That The Claims Lacked Inventive Steps.

On April 12, 2018, the administrative chamber of the Intellectual Property Court upheld TIPO’s decision finding that Claims 1-2 and 5-7 of R&H’s patent (Taiwan Patent No. 28+089) were invalid by reason of lack of inventive steps, and dismissed R&H’s administrative action. 

 

Tsar & Tsai represented NexPlanar Corporation who filed the invalidation action against the patent in the proceedings.
