The IP Court held that the registration of the mark “THE ROYAL PARK” should be revoked since it is highly similar to the cited mark “.
The IP Court held in its Judgement dated November 8, 2018 that the mark “THE ROYAL PARK” was very similar to the cited mark “.”, and the goods and services designated by both marks were highly similar as well.
The court held further that the cited mark carried a certain degree of distinctiveness while there was no evidence that the mark “THE ROYAL PARK” had been widely used or known to the relevant consumers in Taiwan.
The IP Court affirmed the TIPO’s decision to revoke the registration of the mark “THE ROYAL PARK”.
