From January through November of 2018, 309 patent applications were filed under the AEP, of which 152 were filed by domestic applicants and 157 were filed by foreign applicants. The top 4 foreign applicants by nationalities were: Japan (78); U.S.A. (32); Germany (9) and Switzerland (7).
Of the applications filed, 160 were made under Category 1 (i.e., the corresponding application had been approved by a foreign patent authority after substantive examination), and the first office action in those matters (including examination opinions and final decisions) was issued in the average of 43.6 days; 10 applications were made under Category 2 (i.e., the EPO, JPO or USPTO had issued an office action during substantive examination but had not approved the corresponding application), and the first office action therein was issued in the average of 51.3 days; 103 applications were made under Category 3 (i.e., the invention application was essential to commercial exploitation), and the first office action in those matters was issued in the average of 80 days; and 36 applications were filed under Category 4 (i.e., the inventions were related to green technologies), and the first office action therein was issued in the average of 63 days.
