Our firm represented Tiger Coatings GmbH & Co. GK (“TCGC”), an Austrian company, to file an opposition petition against Twin Tigers Coatings Co., Ltd.’s trademark registered on paints, coatings, etc., asserting that the distinctive elements “TIGER” and tiger design comprised of the opposed mark is conceptually similar to the client’s cited marks “TIGER”, and used on similar paint/coating goods. In addition, only TCGC has registered TIGER-series trademarks on paints/coatings in Taiwan and, these marks have been extensively used. The extent of the local consumers’ awareness of the cited marks is higher than the opposed mark, which has not yet been used in Taiwan.
The use of the opposed mark, therefore, is likely to cause confusion to the relevant consumers in Taiwan with the cited marks.
Our firm successfully assisted TCGC to obtain TIPO’s revocation of the registration of the opposed mark based upon Article 3-I-(10) of the Trademark Act and, the TIPO’s ruling is now final.
