The Wisconsin Supreme Court unanimously gave Crowell & Moring client Society Insurance a major victory in ongoing litigation over Covid-19 related claims. The Court held that neither indoor dining restrictions nor the presence of the virus within restaurants such as Colectivo Coffee Roasters triggered coverage under property insurance policies.
The Wisconsin Supreme Court reversed a February 2021 ruling that had allowed a proposed class action against Society to proceed in seeking coverage for businesses’ Covid-related financial losses, including for business-income interruption. The Court accepted the positions advanced on every issue by Fond du Lac, Wisconsin-based Society Insurance.
Partner Laura Foggan, chair of the Crowell & Moring’s Insurance/Reinsurance Group, argued the case for Society Insurance, supported by a team of litigators handling 100+ suits against Society and giving it a resounding victory in its home state.
