India – Decoding the Code on Social Security, 2019

With a view to limit multiplicity of employment legislations in India and to keep regulations in sync with the requirements of the evolving labour market, the Indian Government has sought to consolidate 44 central employment laws into 4 labour codes:
(a) Code on Industrial Relations,
(b) Code on Social Security,
(c) Code on Occupational Safety, Health & Working Conditions, and
(d) Code on Wages.
The bill introducing the Code on Social Security, 2019 (Social Security Bill) was introduced in the Lok Sabha on December 11, 2019 with a view to amalgamate and replace nine laws related to social security, including the Employees’ Provident Fund Act, 1952, the Maternity Benefit Act, 1961, Payment of Gratuity Act, 1972, and the Unorganised Workers’ Social Security Act, 2008.
The Social Security Bill endeavours to, inter alia, ensure access to health care and provision of income security to workers. The Social Security Bill has now been referred to the Parliamentary Standing Committee on Labour on December 23, 2019 for further examination. The Social Security Bill contains several critical provisions including with respect to the option for employees to reduce their provident fund contributions and provision of benefits to gig workers, platform workers, and unorganised workers.
