Sue Moore, James Watson and Eloise Fardon recently wrote an article for Global Restructuring Review highlighting the key points arising in two notable scheme of arrangement cases “Scheming in Hong Kong: court hands down Winsway and Kaisa decisions”.
The decisions include interesting points relating to consent fees, use of schemes to compromise exclusively foreign law debt and recognition of schemes in the United States. Sue, James and Eloise were part of the wider Stephenson Harwood team acting for Winsway (now known as E-Commodities Holdings Ltd) in its successful restructuring of its offshore bond debt earlier this year.
