In this publication, we would like to emphasize the most significant changes in the legislation of the Republic of Kazakhstan, adopted in August 2020. Important changes have affected the legislation of the Republic of Kazakhstan in the field of public procurement. The decree dated August 25, 2020, introduced amendments into the Rules for the implementation of public procurement using a special procedure. 1
The document stipulates that public procurement by the competition method is carried out without posting the following data on the public procurement web portal and the customers' Internet resource:
- data of the notice on the implementation of public procurement by the competition method;
- texts of tender documentation;
- signed protocols of opening envelopes with applications for participation in the tender;
- protocols of preliminary admission to participation in the competition;
- admission and results of public procurement by tender, except for the case established by paragraph 10-1 of these Rules.
The announcement must contain the following information:
- full name of the customer and organizer of public procurement, their location;
- the method and time of public procurement;
- the code of the purchased goods, works, services according to the nomenclature reference book approved by the relevant body;
- date and time of acceptance of applications from potential suppliers for inclusion in the list of potential suppliers of protocols on preliminary admission to participation in the tender;
- a brief description of the planned public procurement.
Now a potential supplier, who has expressed a desire to take part in the planned public procurement, through the web portal submits petition for inclusion in the list of potential suppliers to the organizer the state procurement.
It is worth mentioning, in case of equality of prices of competitive bids of potential suppliers, the winner is a potential supplier with more experience in the market of purchased goods, works, services that are the subject of the competition.
The amendments were introduced into the Rules for the sale of tobacco products, including products with heated tobacco, hookah tobacco, hookah mix, tobacco heating systems, electronic consumption systems and liquids for them. 2
In contrast with the previous version of the Rules, the mandatory requirements for sellers were verification of buyers' documents shall be carried out only in case of doubt that the buyer will reach twenty-one years old.
On August 12, 2020, government established a quota for attracting foreign labor to carry out labor activities in the territory of the Republic of Kazakhstan for 2020. 3
The percentage of the labor force is:
- by permits issued by the local executive body to the employer in the amount of 0.32%;
- to attract labor immigrants in the amount of 3.9%.
