Discretionary family trusts are common tools for wealth and succession planning. Under trust laws, assets settled in the trust no longer form part of the assets of the settlor nor are they assets of any of the beneficiary. However family trusts are increasingly subject to attacks in family courts when parties apply for ancillary relief, resulting in some trusts being varied, treated as a sham, or being treated as resources available to the settlor or beneficiary who is party to the proceedings – i.e. effectively allowing the estranged spouse who may not be a beneficiary to benefit from the trust assets.
This webinar will look at a few examples of case-law where the trusts remained robust in the face of attack versus those that did not, and explore some lessons learnt from such examples. In this third installment of our managing your relationships and finances during the pandemic webinar series, we will further look at the impact of marriage and divorce on estate, trust and succession planning.
Our speakers, Deirdre Fu and Sarina Cheung, will cover topics including the treatment of trust assets on divorce of a beneficiary of the trust, practical tips for trust establishment and administration for pre-marital planing, as well as other wealth and succession planning issues related to marriage and divorce.
This webinar will be conducted in English and Cantonese separately. Each webinar will be 45 minutes long, followed by 15 minutes of Q&A.
