Crowell & Moring partners Paul Haskel and Paul Muscutt, senior counsel Scott Lessne, and counsel John Laird authored a chapter entitled “An Overview of Litigation Funding” for the International Comparative Legal Guide – Lending & Secured Finance 2025 edition.
The chapter dives into litigation funding, “the legal structure whereby a third-party stranger to litigation provides funding to litigants to finance the fees and expenses of litigation with the hope of receiving a substantial return on the funding investment upon the resolution of the litigation.” The authors explore the regulation of these agreements, the privilege issues, and the underwriting process, among other topics.
Haskel is co-chair of the firm’s Financial Services Group and is based in New York. He is a well-regarded advisor in the growing area of litigation finance. He regularly provides advice to litigation funders, private equity firms, and multi-strategy hedge fund clients in connection with their investments in funding transactions, including claims monetization and the provision of non-recourse capital to both plaintiffs and law firms. He is a frequent contributor on these topics and has been featured in Litigation Finance Journal, ValueWalk, and The American Lawyer. In addition, Haskel advises in the field of secondary distressed and high-yield debt transactions.
Muscutt is a member of the firm’s Corporate Group in the London office. His practice covers all aspects of contentious and noncontentious insolvency, with specific knowledge of contentious work and focus on the asset-based lending sector. Muscutt acts for financial institutions, private equity investors, insolvency practitioners, directors, and corporate clients.
Lessne chairs the firm’s Commercial Finance & Lending team based in Washington, D.C. His practice involves the representation of financial institutions and corporate clients in connection with the negotiation and documentation of commercial, asset-based, project-related, and real estate loan transactions, as well as advising clients on legal issues arising in complex single and multi-lender loan workouts and restructures.
Laird is a solicitor-advocate in the firm’s London office, where he is a member of the International Dispute Resolution group. He has a transatlantic practice representing clients in commercial and investment arbitration, and commercial litigation in the English courts including competition claims and trade remedies disputes.
