In the June edition of GC Agenda China, (subscription required), Morrison & Foerster partner Paul McKenzie commented on the National People’s Congress Standing Committee’s newly enacted Data Security Law, which will take effect on 1 September 2021.
“The new law is a key addition to China’s national security infrastructure and provides for a host of protections for data considered to have significance for China’s national interests. Particularly noteworthy for international businesses are provisions restricting cross-border transfers of so-called ‘important data,’ restrictions on the provision of data to foreign government agencies and judicial authorities, and the jurisdictional scope of the law, which covers not only persons and activities in China but also data processing activities undertaken outside China that harm specified Chinese national interests. It will be critical for companies to monitor developments relevant to the law both leading up to and after its coming into effect 1 September,” said Paul.
