Following the introduction of electronic filing for trademark renewal in October 2015, the Ministry of Law and Human Rights officially launched electronicbased intellectual property services on 29 December 2016. The electronic based IP services currently include the following:
- Electronic searches of patents, trademarks, industrial designs and copyright.
- Electronic filing system for registration of new applications for patents, trademarks, and industrial designs, and applications for recordation of copyright.
- Electronic filing system of IP infringement claims.
The electronic IP filing system is currently available in Indonesian for registered IP consultants only. Copyright electronic recordation is available for IP consultants, as well as certain government institutions, and micro, small and medium businesses. IP owners and consultants are now able to file claims of infringement electronically
through the website of the Directorate General of Intellectual Property.
The electronic filing system enables IP consultants to file applications at any time online, without being constrained by the limited opening hours of the Intellectual Property Office. The Intellectual Property Office will issue confirmation of the filing upon submission of the application. The filing date of applications which are filed on non-working days will be the following working day.
With regard to the electronic filing system for registration of new applications for trademarks, unlike the manual filing system, which allows filing of applications with minimum requirements only, the electronic filing requires submission of complete supporting documents. The system will reject applications if there are any incomplete documents/information. Further, the electronic filing system requires the applicant's email address and telephone number, which are not required under the manual filing system. The policy to accept only complete applications is expected to shorten the administration examination process of applications. Further, electronic filing is also expected to reduce error in data input of applications which often occurs during manual filing.
Since the electronic-based services are new, we expect that there may be some glitches with the implementation. However, the new services show the government's strong commitment to improve the system.
