Kazakhstan - Features Of Imposing Forfeit Payments In Civil Litigation.

Alone in 2023, more than 180 final decisions on cases with claims for forfeit payments were rendered in Kazakhstan’s courts. The issue of claiming forfeit payment may seem quite an ordinary and well-explored domain. However, the question of forfeit payment recovery for the period of court proceedings themselves has not received due attention both from court practice and doctrinal interpretation. Therefore, we prepared an analysis of relevant provisions of legislation based on its practice to help raise these acute issues in our legal society.
