Introduction
The Mechanism For Forming And Approving Prices For Products Under PPP Projects Is Defined In The New Resolution Of The Cabinet Of Monisters No.259 From April 26, 2020.
The new scheme for implementing PPP projects that was developed in accordance with the Law “On public-private partnership”1 , includes the following stages:
- initiating, developing a project and selecting a private partner;
- preliminary evaluation of the project;
- preparation of the project concept;
- reporting on ongoing projects;
- maintaining a register of PPP projects.
The state partner conducts a preliminary assessment of the proposed PPP project in order to study its implementation possibilities. To do this, the project is checked for a compliance with certain criteria and conditions. If the results are positive, the project is initiated and prepared.
Project initiation includes:
- development, evaluation and approval of the project concept (standard form is provided in the Annex to the act);
- review and approval of the concept by the authorized state body;
- approval of the agreed project concept by the state partner or the Government;
- inclusion of the project concept by the authorized state Agency in the register of PPP projects.
The costs of production and sale of products (works, services) that justify prices (tariffs) for PPP projects are determined in accordance with the Regulations on the composition of costs for production and sale of products (works, services) and on the procedure for generating financial results and other regulatory acts.
Prices (tariffs) for monopoly or natural monopoly products are approved by the Ministry of Finance and on its behalf by the financial departments on the basis of a written request from the state partner, or are set in the form of fixed or marginal prices (tariffs) for certain types of goods in accordance with the decisions of the President. Prices for other products (works, services) under PPP projects are approved by the state partner in consultation with the private partner.
