Facts
Fox Head, Inc. (the "Applicant") applied to register its trade mark," "(the "Application Mark") in Class 25. Fox Street Wear Pte Ltd (the "Opponent") sought to oppose the registration of the Application Mark on the basis of its earlier mark " "relying on Sections 8(2)(b) (confusingly similar marks and/or goods), 8(4) (well-known in Singapore and/or to the public at large in Singapore), 8(7)(a) (passing off), 7(6) (bad faith), and 8(7)(b) (earlier prior right arising from copyright law) of the Trade Marks Act (Cap. 332) (the "TMA").
