On 25 June 2019 the Ministry of Commerce issued the ministerial regulations exempting certain back office activities from the Foreign Business Act, effective immediately.
As mentioned in our previous client alert on this issue in May 2019 (Foreign Business Act: Liberalization for Back-office Activities in Progress), foreign majority-owned companies intending to provide the following service activities to affiliated/group companies, which have relationships as described in the ministerial regulations, are no longer required to obtain foreign business license to conduct such activities.
- lending money to affiliated/group companies in Thailand
- renting out office space, including public utilities to affiliated/group companies
- providing consultation and recommendations to affiliated/group companies in the following fields:
- management
- marketing
- human resources
- information technology
