On 28 May 2026, the Hong Kong Judiciary announced the establishment of the Hong Kong International Commercial Court (HKICC), a specialist division of the High Court to handle complex, high-value cross-border commercial disputes. A dedicated Practice Direction will set out its jurisdiction and procedures.
A Specialist Forum Alongside Arbitration
The HKICC is designed to streamline and accelerate sophisticated cross-border disputes within Hong Kong’s existing legal framework.
For parties considering arbitration, the HKICC introduces a new court-based option alongside Hong Kong’s established arbitration offering. Its precise jurisdiction will be defined in the forthcoming Practice Direction, which will be key when comparing litigation and arbitration.
The HKICC complements Hong Kong’s broader dispute resolution framework and reinforces its position as a forum for international disputes.
Why Hong Kong
Hong Kong’s status as a dispute resolution hub continues to grow, across both courts and arbitration.
- A common law system familiar to international parties
- Strong links to Chinese Mainland, making it an attractive forum and governing law choice
- A trusted bridge between East and West
The HKICC strengthens this position, offering a dedicated court forum.
What This Means for You
The HKICC is relevant to parties considering arbitration or reviewing dispute resolution clauses.
- Monitor the forthcoming Practice Direction
- Consider how the HKICC compares to other forums/dispute resolution processes for your disputes
- Factor it into forum selection in cross-border agreements
